This Company / Outsourcing Client Agreement applies to any company, organisation, institution, business entity or authorised representative that approaches, engages, contracts with, or uses the staffing, outsourcing, technical, training, consultancy or other professional services provided by Pertecnica.

1. Acceptance of Terms

By accessing the Pertecnica website, submitting an enquiry, requesting a proposal, sharing a requirement, entering into an engagement, or using any service provided by Pertecnica, the company acknowledges that it has read, understood and accepted the applicable terms and conditions.

Any decision made by a company based on information, descriptions, service details, capabilities or other content published on the Pertecnica website is made at the company’s own discretion and constitutes acceptance of the applicable terms.

2. Scope of Services

Pertecnica may provide technical staffing, outsourcing support, training, skill-development, consultancy, engineering or other professional services as mutually agreed.

The actual scope, deliverables, timelines, commercial terms and responsibilities shall be determined by the applicable proposal, quotation, work order, service agreement or other written communication accepted by both parties.

3. Personnel and Staffing

Where personnel are introduced, trained or provided for a company’s requirement, selection, interview, engagement, deployment and continuation shall be subject to the agreed process.

The company is responsible for communicating accurate job descriptions, required qualifications, working conditions, location, compensation and other relevant requirements.

Pertecnica does not guarantee the permanent availability, performance or continued engagement of any particular individual unless expressly agreed in writing.

4. Company Responsibilities

The company shall provide a safe and appropriate working environment and comply with applicable laws, regulations and workplace requirements relevant to its operations and personnel.

The company shall provide necessary information, access, resources, supervision and cooperation required for the agreed services.

5. Commercial Terms

Fees, payment schedules, taxes, reimbursements, cancellation terms, replacement terms and other commercial conditions shall be governed by the applicable quotation, proposal, purchase order or written agreement.

Any additional work or service outside the agreed scope may be subject to additional charges.

6. Confidentiality and Information

Both parties should take reasonable measures to protect confidential business, technical, commercial and personal information received during the engagement.

Neither party shall use confidential information obtained through the engagement for purposes unrelated to the agreed services, except where required by law or otherwise authorised.

7. Third-Party and Employment Decisions

Where Pertecnica facilitates interaction between candidates, personnel and companies, the final decision regarding selection, employment, deployment, compensation, promotion, termination or continuation rests with the relevant company or employer, subject to applicable law and the agreed contractual arrangement.

Pertecnica is not responsible for decisions independently made by the company or by third parties.

8. Limitation of Responsibility

Business, staffing, training and outsourcing outcomes may depend upon factors beyond Pertecnica’s reasonable control. Pertecnica shall not be responsible for losses, expectations, assumptions or commitments arising from information that was not expressly confirmed in writing by an authorised representative of Pertecnica.

9. Agreement

By continuing to use the Pertecnica website or engaging its services, the company confirms that it has understood and accepted this Agreement and any additional written terms applicable to the particular engagement.
